The provision of art. 49 of the Polish Consular Law, is inconsistent with art. 34 and art. 36 of the Polish Constitution, and there is also no basis in international law or practice (custom) for its application.

Art. 49. [Ograniczenia w udzielaniu pomocy konsularnej obywatelom polskim posiadającym obywatelstwo państwa przyjmującego]
1. Przepisów art. 20 i art. 39 nie stosuje się do obywateli polskich posiadających obywatelstwo państwa przyjmującego.
2. Przepisów art. 21 nie stosuje się do obywateli państw członkowskich Unii Europejskiej posiadających obywatelstwo państwa przyjmującego.

The authorities of the Republic of Poland are not entitled within the constitutional law to selectively perform their duties under art. 36 of the Constitution with discrimination based on their assessment of the situation of a citizen and of the possibility of obtaining consular or territorial care or help in his case from another state. The provision of art. 36 of the Constitution gives an absolute right to consular assistance for citizens, not a right relative to any action of a foreign state and to the assessment of such action as being allegedly better or “fuller”.

The German consular law allows the refusal of consular assistance to persons who have German citizenship and citizenship of a foreign state at the same time, as well as to their descendants, if it is true at the same time that: (1) they have their usual place of residence in the territory of that state, and not only stay on its territory; and (2) their mother or father also had the citizenship of that foreign state; and (3) the consul did not decide to provide assistance on an equitable basis.
